HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Father of the petitioner was Conductor in the respondentTransport Corporation. Disciplinary proceedings initiated against him, resulted in imposing punishment of removal from service by order dated 15.05.2018. Father of petitioner filed appeal against the order of removal to the Divisional Manager, acknowledged by the Office of the Divisional Manager on 30.06.2018. Petitioner seeks to prosecute the remedy of appeal before the appellate authority. In the event of family members succeeding in convincing the appellate authority against the order of removal from service and if relief is granted, it is possible for the petitioner to apply for appointment on compassionate grounds and family members are also entitled to receive terminal benefits. Therefore, family members can prosecute the remedy of appeal already filed by the deceased-employee.

Since appeal is already received and pending consideration by the appellate authority, the Divisional Manager (3rd respondent) is directed to dispose of the appeal by objectively considering the grounds urged in the appeal, if the same is not already disposed of, as expeditiously as possible, preferably within a period of six weeks from the date of receipt of copy of this order. Writ Petition is accordingly disposed of. Pending miscellaneous petitions shall stand closed.
