O R D E R

The 2nd respondent herein filed a complaint against the petitioner alleging that her engagement was performed with the petitioner and thereafter, they lived together and lead marital life and when she asked the petitioner to marry her, he started harassing her and stated that he will not marry her. Based on the said complaint, the Station House Officer, KPHB Police Station, Cyberabad District registered a case in Cr.No.792 of 2015 for the offences punishable under Sections 417, 483, 342, 323, 506 of IPC and later the criminal case was number as C.C.No.1574/2015 on the file of III Additional Junior Civil Judge - cum - XIX Metropolitan Magistrate, Kukatpally at Miyapur Cyberabad. The petitioner filed this criminal petition under Section 482 Cr.P.C. seeking to quash the said proceedings, on the ground that no prima facie case is made out against the petitioner in the charge sheet.

Heard the learned counsel for the petitioner and the learned Public Prosecutor (Telangana) for the State.

The charge sheet is filed and the case is under trial. The truth or otherwise of the allegations can only be decided during the course of trial and I do not see any ground to quash the proceedings at this stage. However, the learned trial court is directed to dispose of C.C.No.1574 of 2015 within a period of three months from the date of receipt of a copy of this order, without affording unnecessary adjournments to the parties concerned.

With the above direction, the criminal petition is disposed of. No costs. Miscellaneous petitions pending if any, shall stand closed. ---------------------------------- M.S.K.JAISWAL,J
