O R D E R

This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused in Crime No.163 of 2026 before the Cherlapally Police Station, Malkajgiri District, registered for the offences punishable under Section 109 of BNS.

The brief facts of the case are that, on 17.05.2026, the de-facto complainant alleged a report before the Police and stating she residing with her husband and two children, alleged that her husband used to frequently quarrel with and physically assault her over petty issues. On 17.05.2026, when she intended to attend her sister's marriage alliance meeting, her husband objected, picked up a quarrel, assaulted her, and forcibly hit her head against the wall. He then strangulated her with a chunni, causing her to lose consciousness, and locked the house from outside, believing she had died. Later, her family members rescued her and shifted her to the hospital. Based on the said complaint, the police registered a case for the aforesaid offence. During investigation, the victim's statement was recorded, the scene of offence was inspected in the presence of mediators, and a panchanama and rough sketch were prepared. A grey-colored chunni used in the offence was seized, and statements of witnesses were recorded.

Heard Sri Rajashekhar Reddy Jejala, learned counsel for petitioner as well as Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State.

Learned counsel for the petitioner submitted that the petitioner is falsely implicated in the present case and has not committed any offence as alleged. It is also submitted that the petitioners have been in judicial custody since 18.05.2026 and that the material part of the investigation has already been completed. It is further submitted that both the parties have agreed to compromise the matter for the sake of their children. Therefore, he prayed the Court to grant bail to him by allowing this criminal petition.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the allegations against the petitioner are serious in nature. Further, the investigation is completed and also filed charge sheet. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner herein is in jail since 18.05.2026. As seen from the record, the injuries are simple in nature, and the investigation has been completed and also

- 4 - filed charge sheet. Considering the facts and circumstances of the case, the nature of the allegations, the duration of incarceration, the progress in the investigation, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned II Additional Judicial Magistrate of First Class, Medchal-Malkajgiri District, Kushaiguda.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3)

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
