THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.41854 OF 2015 O R D E R :

Heard.

The petitioner questions quantification of the regularisation fee as per the orders passed by the 4th respondent in Endorsement No.E/07/59/2015, dated 31-08-2015.

The petitioner states that assessment of the value is too inflated and has filed a representation before the 4th respondent on 28-10-2015 requesting to re-assess the regularisation fee. The present writ petition is filed alleging inaction on the part of the 4th respondent.

I am, however, unable to see any power of the 4th respondent to revise the assessed value under G.O.Ms.No.58 Revenue (AssignmentII) Department dated 30-12-2014. The petitioner, however, can seek redressal of his grievance before the authority viz., the Joint Collector as specified under para 4 (xiii) of the said G.O. and the petitioner has not availed the said remedy. Hence, if the petitioner is so desires, it is open for him to seek appropriate redressal from the said authority with respect of his grievance and if any such application is filed, the Joint Collector will examine the same and take appropriate decision expeditiously in accordance with the aforesaid G.O.

Accordingly, the writ petition is disposed of. No costs Miscellaneous petitions, if any, pending shall stand closed. _____________________ VILAS V.AFZULPURKAR, J Date:23-12-2015 Prv
