THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 4792 OF 2017 O R D E R :

The petitioner claims to be the owner and possessor of the landed property bearing H. No. 4-7-20 in Survey Nos. 351, 352 and 353 situated at Prakash Nagar, Khammam Urban Mandal, Khammam District, which was, in fact, assigned to her by way of a patta by the government. Now, her grievance is that Respondents 5 and 6, who are stated to be Corporator and Ex-Councillor, have been carrying on the illegal construction by encroaching her landed property. Though the petitioner complained of the said constructions, by submitting a representation on 27.01.2017, the official respondents have not acted thereon so far, is the grievance set out in this Writ Petition.

Learned counsel for the petitioner fairly submits that since the petitioner has already submitted the representation dated 27.01.2017 to the respondent authorities, the same may be directed to be considered.

Heard learned Standing Counsel for the 2nd respondent municipality.

Considered the submissions made by the learned counsel on either side. A copy of the patta document, which was placed before this Court, has also been perused. In the fitness of things, it would be appropriate for this Court to direct Respondents 3 and 4 to consider the representation dated 27.01.2017 of the petitioner and, if the allegations made therein are found to be true, to take necessary action in the matter, in accordance with law. With this, the Writ Petition stands disposed of. No costs.

Consequently, the miscellaneous Applications, if any shall also stand disposed of.
