THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.9739 of 2016 ORDER:

This petition under Section 482 Cr.P.C., is filed by the petitioner/A.2 seeking to quash the proceedings in C.C.No.165 of 2014 on the file of Additional Judicial Magistrate of First Class, Yelamanchili, registered for the offences punishable under Sections 188, 177 (e) read with 34 IPC and Section 123 of the Representation of People Act, 1950.

2. Heard learned counsel for the petitioner/A.2 and learned Additional Public Prosecutor representing the State.

3. There are serious allegations against the petitioner/A.2. Therefore, it is not a fit case where the proceedings against her can be quashed. Truth or otherwise of the allegations can only be decided during the course of trial. However, considering the facts and circumstances of the case, the Court below is directed to proceed with the trial in C.C.No.165 of 2014 pending on the file of Additional Judicial Magistrate of First Class, Yelamanchili and dispose of the same within a period of six (6) months from today without insisting the presence of the petitioner/A.2 on each and every date of adjournment, unless it feels that her presence is necessary for any specific purpose. However, A.1 shall appear before the trial Court during trial.

4. With the above directions, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
