THE HON'BLE SRI JUSTI CE M.S.K.JAI SWAL WRI T PETI TI ON No.7333 of 2006 ORDER:- This writ petition is filed for a mandamus, declaring the action of the respondent in not returning the petitioner's original patta in respect of Plot No.82-B, Zebabagh, Asifnagar, Hyderabad, as illegal and arbitrary. Admittedly, the petitioner borrowed a loan from the respondent bank by depositing his original patta belonging to Plot No.82-B, Zebabagh, Asifnagar, Hyderabad. The respondent bank issued a notice to the petitioner on 22.09.1988, calling upon the petitioner to clear off the loan amount, which was quantified at Rs.3,915-70 ps.
It is submitted by the learned counsel for the petitioner that part of the loan was repaid, even otherwise, the same was waived by the Government.
In view of the above, the Writ Petition is disposed of, directing the respondent bank to return the original patta of the petitioner, if the loan is no longer outstanding. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed in consequence.
