THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.8507 of 2008 ORDER:

This writ petition is filed seeking the following relief/s: 'To pass appropriate writ, order or direction more particularly Writ of Mandamus by declaring the election of the 4th respondent to the M.P.T.C as void and illegal and consequently declare that the petitioner as Returned elected candidate for Balapanuru S.C. reserved M.P.R.C constituency of Panyam Mandal and pass any other order'.

[Reproduced verbatim] The learned counsel for the petitioner submits that the cause in the writ petition does not survive for adjudication and that therefore, the writ petition may be dismissed as infructuous giving liberty to the petitioner to challenge the caste certificate of the 4th respondent.

Recording the aforesaid submission, the Writ Petition is dismissed as infructuous giving liberty to the petitioner to challenge the caste certificate of the 4th respondent before an appropriate authority by instituting an appropriate proceeding, which the law permits. There shall be no order as to costs. Miscellaneous petitions pending, if any, in this writ petition shall stand closed.
