Heard Sri V.S.K.Rama Rao for petitioner, Assistant Government Pleader (Panchayat Raj) for respondents 1, 4 and 5, Assistant Government Pleader (Revenue) for respondents 2 and 3 and Sri Ravi Cheemalapati for 6th respondent.
The complaint of petitioner is against construction of park in an extent of Ac.0-15 cents in Sy.No.358/ 4 of Pidimgoyyi Village, Rajamahendravaram Rural, East Godavari District. I have perused the averments in the writ affidavit and the documents on which the petitioner is relying upon. This Court is of the view that the prayer under Article 226, having regard to nature of controversy, is not an appropriate remedy and the petitioner has to work out all the grievances against respondents in a properly instituted suit or proceeding. On the ground that the writ is not maintainable for the prayer has to be properly worked out in an instituted suit, the writ petition is dismissed by granting liberty to work out remedies. Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
