THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 6683 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/Accused No.3 seeking bail in the event of her arrest in connection with Crime No.8 of 2023 on the file of Attapur Police Station, Cyberabad, registered for the offence punishable under Section 307 of Indian Penal Code. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The de facto complainant lodged a complaint against the petitioner and her son alleging that they are neighbours and they have entered into altercation with the sons of the de facto complainant and injured them with an iron rod. As seen from the remand report, it is stated that this petitioner and her husband instigated A-1 to beat the injured.

Since there are no specific over tacts attributed to this petitioner and the petitioner being a lady, this Court deems it

appropriate to grant anticipatory bail to the petitioner/A-3 in the event of her arrest, subject to the following conditions:

1) The petitioner/A-3 is directed to surrender before the Station House Officer, Attapur Police Station, Cyberabad, within a period of ten days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/A-3 on bail, on her executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/A-3 shall appear before the police on every Monday between 10.00 a.m. to 1.00 p.m. for a period of eight weeks, for the purpose of investigation.

3) The petitioner/A-3 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
