This civil revision petition is filed against the order dated 19.09.2016 in IA No.31 of 2016 in E.O.P.No.5 of 2015 on the file of the Election Tribunal Authority-cum-Junior Civil Judge, Ponduru, Srikakulam District, by and under which, the Tribunal has allowed the request of the election petitioner for production of the election material. During course of hearing, the learned counsel for the 1st respondent submitted that the election OP is at the fag end of the conclusion and therefore, a direction may be issued to the Tribunal to dispose of the election OP as expeditiously as possible. The learned counsel appearing for the petitioner raised no objection, however, he sought for a direction not to resort recounting of votes.

Having heard the learned counsel on either side, the Civil Revision Petition is disposed of, directing the Tribunal below to dispose of the election O.P. as expeditiously as possible, preferably, within a period of 2 (two) months from the date of receipt of a copy of this order. It is needless to say that the Tribunal below shall not resort to recounting of votes, unless it is satisfied on the basis of evidence adduced before it that a case for directing recount of votes has been made out by the election petitioner. No order as to costs.

Pending miscellaneous applications, if any, shall stand closed in consequence.
