HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.33735 OF 2015 ORDER:
This Writ Petition is filed by the petitioner invoking Article 226 of the Constitution of India seeking to declare the inaction of respondents 2 to 4 in considering the representations of the petitioner made on 17.08.2015, 21.08.2015 and 11.09.2015 as illegal and arbitrary.
Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.
Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer seeking a direction to the 2nd respondent-The District Collector to consider the representation made by the petitioner on 11.09.2015. Learned AGP would submit that the 2nd respondent may be directed to dispose of the representation made by the petitioner, if not already disposed of and if pattas are not cancelled. Having regard to the rivals submissions made, the Writ Petition is disposed of directing the 2nd respondent-District Collector to consider the representation made by the petitioner on 11.09.2015 seeking cancellation of pattas granted in respect of poramboke land in survey No.108/2 of Neelakantapuram Village, Hanumanthunipadu Mandal, Prakasam District, if the pattas are not already cancelled, and pass necessary orders thereon, in accordance with law, at the earliest. It is needless to mention that
the 2nd respondent shall hear the petitioner as well as the other aggrieved persons, if any, before passing any order. Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
