THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8697 OF 2016 ORDER:

This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner/A.9 seeking bail in crime No.212 of 2016 on the file of the P.S., Ibrahimpatnam, Vijayawada, Krishna District, registered for the offence under Section 8(c) read with Section 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act (NDPS Act).

Heard and perused.

The allegation against the petitioner/A.9 is that the petitioner/A.9 and other accused were found in illegal possession of 3204 kgs., of Ganja.

Learned counsel for the petitioner submits that the petitioner has not committed any offence and that he has been falsely implicated in the present case. He prays this Court to grant bail to the petitioner. Considering the fact that the quantity of Ganja, which was found in possession of petitioner/A.9 is commercial quantity and also as there is a bar to grant bail in case of commercial quantity, this Court is not inclined to grant bail to the petitioner/A.9.
