C Vidyavathi v. The Divisional Police Officer
THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.26286 of 2012 ORDER:
The grievance of the petitioner in this case was that the police authorities were not giving her protection in terms of the judgment and decree passed by the learned IX Additional District Judge, Nizamabad District at Kamareddy, in O.S.No.7 of 2009. The said suit was filed by the petitioner for a decree of injunction against respondents 3 and 4 herein and was decreed on 22.02.2011.
Significantly, there was no direction by the civil Court that the police authorities should secure due compliance with the injunction granted.
In that view of the matter, the petitioner cannot assume as a matter of course that the police would be under an obligation to provide her aid and protection to secure compliance with the civil Court's decree. In the event there is any violation thereof, it is for the petitioner to take recourse to appropriate remedies available in law. Reserving liberty to the petitioner to do so, the writ petition is dismissed.
Pending Miscellaneous Petitions shall also stand dismissed. No order as to costs.
