HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.8193 OF 2017 ORDER:

This writ petition is filed by the petitioner challenging the inaction of respondents Nos.1 and 2 in taking steps against the unauthorized constructions made by the 3rd respondent.

The case of the petitioner is as follows:

The petitioner is the owner of plot in Sy.No.521/MCH No.4/3/145 and 4/3/140/B situated at Attapur, Ranga Reddy District, and he let out the same to tenants. Respondent No.3 is running a function hall under the name and style of S.N.R. Garden Function Hall at a Plot in Sy.No.520, situated at Attapur, without having any safety measures and without having sufficient parking place. The staff of the 3rd respondent and the customers are parking their vehicles on the footpath and the road, as a result of which, much inconvenience is being caused to the residents of that locality. Further, the staff of the 3rd respondent are dumping garbage in the property of the petitioner. The petitioner came to know that no permission was accorded for any construction over the premises in Sy.No.520 of Attapur. The petitioner made several representations to respondents Nos.1 and 2 to take necessary action against the illegal constructions made by the 3rd respondent. But the Official respondents have not taken any action so far.

Heard and perused the material available on record. 4.

The main grievance of the petitioner is that he made several representations to respondents Nos.1 and 2 against the illegal constructions

made by the 3rd respondent. But the official respondents have not taken any action so far.

Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion, this Writ Petition is disposed of with the following direction:

"Respondents Nos.1 and 2 are directed to consider the representations of the petitioner and take appropriate action in accordance with law, against the illegal constructions, if any made by the 3rd respondent as alleged by the petitioner." No costs. Consequently, Miscellaneous petitions pending, if any, shall stand closed.
