Petitioner, who is a contractor, and the sixth respondent had participated in the tender inviting applications for improvements to Perusomula to Petnikota via Mirjapuram and Kolimigundla. One of the conditions as per the tender notification is that the ongoing contracts have to be disclosed in the tender schedule in the offer document, which consists of two parts one is technical bid and the other is financial bid. It is case of the petitioner that the sixth respondent has failed to disclose the certain of the work which he is already exceeding as is required in the tender conditions. Bringing all these matters to the notice of the authority, petitioner submitted representations dated 08.09.2016 and 19.09.2016. Without considering the same the tender offered by the sixth respondent shall not be permitted as a responsive bid on account of the disqualification. Complaining inaction on the part of the respondents, the present writ petition is filed. 3.

Learned Government Pleader has placed on record the instructions received from the Superintendent Engineer. Operative portion of which reads as follows:

"It is submitted that pursuant to the said representation, the Superintending Engineer, R&B (R&B) Circle, Kurnool addressed a letter to the Executive Engineer Godavari Eastern Division,

Dowlaiswaram, East Godavari District vide R.No.3/Tenders/AEEI/KNL/2016 dated 23.09.2016 and other authorities requesting them to verify into the matter and to furnish information and FAX for taking necessary action on the representation of the petitioner herein dated 08.09.2016. The information/particulars are awaiting from the concerned departments."

In the light of the written instructions, as the respondent‐ authorities themselves are enquiring into the matter, it would suffice if the stand of the respondents is placed on record. No orders, as such, are required in the writ petition.

Writ petition is accordingly closed.

As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
