THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SMT.JUSTICE T. RAJANI Writ Petition No.8436 of 2008 Order: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) The present writ petition is filed questioning the action of the respondents in refusing to consider the 'C' forms produced by the petitioner, and in issuing endorsement dated 11.3.2008 returning the 'C' Forms on the ground that the assessment order had already been passed. The petitioner complains of violation of principles of natural justice contending that the endorsement was passed even without giving the petitioner an opportunity of being heard. By way of an interlocutory order, all further proceedings pursuant to the assessment order dated 10.12.2007 was stayed. The interim order has been in force for the past nine years.
We consider it appropriate in such circumstances to dispose of the writ petition setting aside the impugned endorsement, and directing the Commercial Tax Officer to give the petitioner an opportunity of being heard and thereafter, consider his request for acceptance of the 'C' Forms produced by him, in accordance with law. The writ petition stands disposed of accordingly. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
