THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.12148 OF 2015 ORDER:
1 This petition is filed under Section 482 Cr.P.C seeking to quash the proceedings against the petitioner in C.C.No.1196 of 2010 on the file of the Court of the I Additional Chief Metropolitan Magistrate, Visakhapatnam.
2 When the matter is taken up for hearing, the learned counsel for the petitioners has sought permission of the Court to permit the petitioners to withdraw the petition with liberty to avail the remedies available to them under law. He further requested that the presence of the petitioners before the trial Court may be dispensed with on each and every date of adjournment. Permission is accorded. In the result, this Criminal Petition is dismissed as withdrawn granting the liberty as prayed for. Since the third petitioner / A.5 is resident of Secunderabad, his presence before the trial Court on each and every date of adjournment is dispensed with. However, the 3rd petitioner / A.5 shall appear before the trial Court as and when his presence is so required.
The trial Court is further directed to dispose of the matter as earlier as possible, preferably, within six months from the date of receipt of a copy of this order. As a sequel, miscellaneous petitions, pending if any in this Criminal Petition, shall stand closed. _____________________ T.
