THE HON'BLE SRI JUSTICE K.C.BHANU AND THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION No.14617 of 2015 ORDER: (per Hon'ble Sri Justice K.C.Bhanu) This Writ Petition, under Article 226 of the Constitution of India, is filed to set aside the Advocate Commissioner warrant dated 02.02.2015, issued in Crl.M.P.No.205 of 2015 on the file of the Chief Metropolitan Magistrate, Cyberabad, which is returnable by 10.08.2015, and consequently, to declare the possession notice dated 28.09.2013 issued by respondent No.1 bank as null and void.
2. Heard both sides.
3. Learned counsel for the petitioner stated that if reasonable time is granted, the petitioner is ready to pay the entire outstanding loan amount due to respondent No.1 bank together with interest.
4. Considering the request made by the learned counsel for the petitioner, we dispose of the Writ Petition by permitting the petitioner to deposit 50% outstanding loan amount within a period of four weeks from the date of receipt of a copy of this order and to deposit the remaining 50% outstanding loan amount within four weeks thereafter. If the petitioner fails to fulfill any one of the above conditions, respondent No.1 bank is at liberty to proceed with further in accordance with law. The Registry is directed not to entertain any application for "extension of time" or "for being mentioned" in this regard. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
