Heard.
The only grievance of the petitioners is that the appeal filed by them in Appeal No.Rc/E2/12871/2012 before the District Collector, Anantapur District, the 3rd respondent, is not being taken up and disposed of so far. The petitioners claim that they have a good case in view of the decision of the Supreme Court in Government of Andhra Pradesh v. K. Varalaxmi and others[1].
On the last date of hearing, learned Government Pleader for Revenue was required to get instructions as to whether the appeal of the petitioners was pending. He now states that the said appeal is pending and that appropriate steps would be taken to dispose of the same shortly, keeping in view the decision of the apex Court in Civil Appeal No.3673 of 2009.
As the petitioners appeal is pending since 2012 before the 3rd respondent, I deem it appropriate to direct the 3rd respondent to fix an early date for hearing of the appeal and dispose of the same in accordance with law, after notice to petitioners and the affected parties, if any.
The Writ Petition is accordingly disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
