ORDER:
The proceedings dated 04.07.2008 issued by the 1st respondent under Section 6A of the Essential Commodities Act for violation of certain provisions of A.P. State Public Distribution System Control Order, 2008, are under challenge in this writ petition. This Court by order dated 17.04.2009 granted interim suspension, as prayed for, however, giving liberty to the authorities to conduct enquiry and to pass appropriate final orders. Learned counsel for the respondent submits that on account of non-availability of certain records, enquiry has not been completed. In that view of the matter, no useful purpose would be served by keeping the writ petition pending as the writ petition itself is filed against the suspension pending enquiry.
Therefore, the writ petition is disposed of. However, considering the fact that this Court granted interim suspension on 17.04.2009, the same shall be continued till the completion of the proceedings initiated under Section 6A of the Act, by the respondent authorities. As the writ petition is pertaining to the year 2009, the entire exercise shall be completed within a period of three months from the date of receipt of a copy of this order.
As a sequel, pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
