THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.19699 OF 2017 ORDER:

This writ petition is filed seeking to issue a writ of mandamus to declare the action of the respondent in not taking any steps for cancellation of assessment in respect of House No.1-9-1296/ 9, for VLT Tax in pursuance of representation, dated 02.01.2017, made by the petitioner, as illegal and arbitrary.

The case of the petitioner is that her husband owned land of an extent of Acs.1.13 gunats at Shayampet, Jagir Village, Hanamkonda Mandal at present Khazipet Mandal, Warangal Urban District. He died on 19.06.2008 leaving behind the petitioner and their two sons as his legal heirs. Since there is threat from the land grabbers, the sons of the petitioner constructed a shed towards south west corner for Watchman to supervise the land. Recently, they came to know that the respondent Corporation assessed the shed in the name of one Nalla Yadagiri and assigned House Number as 1-9-1296/ 9 for VLT Tax. Immediately, the petitioner submitted representation, dated 02.01.2017, to the respondent requesting to cancel the assessment number issued in the name of said N.Yadagiri. But, no action has been taken by the respondent Corporation so far.

Hence, this writ petition. When the matter is taken up for hearing, learned Standing Counsel for the respondent Corporation submitted that in view of the representation filed by the petitioner, the officials of the respondent Corporation called said Yadagiri to produce all documents, and they will dispose of the representation of the petitioner in accordance with law.

Recording the submissions of the learned Standing Counsel, the writ petition is disposed of. No order as to costs. Miscellaneous petitions pending if any, shall stand closed. ______________ RAJA ELANGO, J July 03, 2017 KTL
