HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No.30700 of 2016 ORDER:

Vide the present petition, the petitioner seeks a direction to decide his representation dated 18.11.2014 for payment of compensation in respect of the land admeasuring Ac.1.621⁄2 cents in Sy.No.575/3 of Bodduvanipalem Revenue Village, Korisapadu Mandal, Prakasam District.

It is stated in the affidavit that the subject land of the petitioner was acquired in the year 2002 for upgradation and improvement of National Highway-5 from Chilakaluripet to Rudrakota section under the provisions of the National Highway Act, 1956. Despite acquisition and utilization of the subject land for National Highway-5, no compensation has been paid.

In the year, 2012, petitioner was informed that compensation would be paid along with compensation payable for further widening of National Highway No.5/bypass road undertaken by the National Highway authorities. Learned counsel for the petitioner has drawn the attention of this Court to letter dated 02.08.2014, wherein the Special Collector (LA), National Highway-5, Prakasam District, Ongole communicated to the Chairman-cumSenior Civil Judge, Mandal Legal Services Committee, Addanki, that the connected file pertaining to acquisition of

land in Bodduvanipalem Revenue Village, Korisapadu Mandal was not traced and thorough search was being made to trace out the file. However, till date, the petitioner has not received compensation, qua the land.

Keeping in view the averments in the Writ Petition, and the submissions of the counsel for parties, I deem it appropriate to direct respondent No.2 to pay compensation to the petitioner in respect of the subject land within four weeks from the date of receipt of a copy of this order. With the above direction, the Writ Petition stands disposed of.

Miscellaneous Petition pending, if any, shall also stand disposed of. However, in the circumstances, without costs.
