B.Veeru Naik, S/O. Dasu Naik, v. The State Of Telangana,
HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.17986 of 2017 ORDER:
Heard both sides at the admission stage.
2.
The grievance of the petitioner in this Writ Petition is that he moved an application before the second respondent under the Right to Information Act, 2005 on 26.7.2016 seeking certain copies of documents but unfortunately the second respondent has not passed any order and kept the application pending till today, therefore, he seeks a suitable direction to the second respondent.
3.
Learned Assistant Government Pleader appearing on behalf of second respondent would submit that the State Public Information Officer relating to second respondent transferred the application put up by the petitioner to Assistant Director of Mines and Geology, Warangal on 8.8.2016 but he has not received any communication from the Assistant Director and hence, the application of the petitioner could not be processed.
4.
The submission of the learned Assistant Government Pleader is not convincing since the application of the petitioner is kept pending for more than 15 months. In these circumstances, while allowing the Writ Petition,
UDPR, J W.P.NO. 17986 OF 2017 a direction is given to the second respondent to obtain the necessary information from the Assistant Director of Mines and Geology, Warangal at the earliest and pass orders on merits on the application of the petitioner dated 26.7.2016 within four weeks from the date of this order. No costs.
5.
As a sequel there to, miscellaneous applications, pending if any, shall stand closed.
