L.Srinivas, v. Vice Chairman And M.D.,Apsrtc,Musheerabad
HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.21862 OF 2002
ORDER
This writ petition is filed seeking the following relief: "... to issue an order, direction or writ particularly one in the nature of Writ of Mandamus or any other appropriate writ, order or direction (i) declaring the action of the respondents in altering the service condition of the petitioner in the category of Man Mazdoor in pursuance of the recommendations of the Industrial Engineering Corporation as illegal and arbitrary (ii) consequently direct the respondents to continue the petitioner in service (iii) to direct the respondents to regularize the services of the petitioner from the date of their initial appointment with all consequential benefits and pass such further order or orders in the circumstances of the case."
Heard Smt K.Udaya Sree, learned counsel appearing for the petitioner and learned Standing Counsel appearing for the respondent-Corporation.
Learned counsel appearing for the petitioner submits that since the petitioner has been continuously working from the date of his appointment in the year 1990 without any interruption, he seeks regularization of his services. Learned Standing Counsel appearing for the respondent-Corporation contends that proposals have been submitted by the respondent-Corporation to the Government
to regularize the services of the similarly situated persons in terms of G.O.Ms.212, dated 22.4.1994.
Having considered the rival submissions made by the learned counsel on either side, this Court is of the view that ends of justice would be met if a direction is issued to the petitioner to submit a representation to the respondentCorporation seeking regularization of his services. Accordingly, the Writ Petition is disposed of directing the petitioner to submit a representation to the respondentCorporation seeking regularization of his services within a period of one week from the date of receipt of a copy of this order and on receipt of such representation, the respondentCorporation shall consider the same and pass appropriate orders within a period of four weeks thereafter. No costs. Miscellaneous petitions, if any, pending shall stand closed.
