THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.33560 of 2015 ORDER:

The grievance of the petitioner was that the seventh respondent was permitted to establish his A4 shop in Pullelivaripet village, which is a hamlet of Avidi Village, Kothapeta Mandal, East Godavari District, though he was allotted a shop at Modekurru Village of Kothapeta Mandal, East Godavari District.

In the light of the controversy raised by the petitioner as to the location of the shop of the seventh respondent, this Court called for a report from the District Collector, East Godavari District, certifying as to whether the shop of the seventh respondent was situated in Avidi Village or in Modekurru Village of Kothapeta Mandal. Pursuant thereto, the District Collector, East Godavari District, filed report dated __/12/2015 confirming that upon the enquiry made by the Revenue Divisional Officer, Amalapuram, it was found that the shop of the seventh respondent was located within Modekurru Village limits and not in Avidi Village.

In the light of the afore-stated report of the District Collector, East Godavari District, the challenge of the petitioner is shown to be without factual basis.

The writ petition is accordingly dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
