HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.25071 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the second and third respondents in not settling the claim pertaining to the expenditure incurred by the petitioner towards Bio-Metric Cards and inspite of confirming that a sum of Rs.27,469/- is due vide the letter of the fourth respondent dated 01.04.2014 bearing Lr.No.238/2013/G7 followed by written representation dated 13.06.2016 as being illegal and arbitrary and consequently direct the respondent authorities to settle and pay the amount due to the petitioner along with interest.

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies.

The contention of the learned counsel for the petitioner is that the petitioner supplied Bio-Metric Cards to the respondents 2 to 4 long back. The respondents 2 to 4 owe an amount of Rs.90,000/- to the petitioner and they are postponing the payment of the said amount for one reason or other. On 13.06.2016 the petitioner made a representation to the second respondent. The only request of the petitioner is to direct the respondents 2 to 4 to consider his representation.

Having regard to the facts and circumstances of the case, respondents 2 to 4 are hereby directed to consider the representation of the petitioner dated 13.06.2016 and pass orders in accordance with law as early as possible, preferably, within a period of two months from the date of receipt of a copy of this

order.

With the above direction, the writ petition is disposed of. As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
