HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18831 OF 2019 ORDER:

This case of the petitioner is that respondent-police illegally detained the vehicle under Registration No.TS-04-ED-1616 belongs to one P.Rajya Lakshmi W/o.Anil Kumar R/o.7-3-301/A/502, Rishitha Towers, Dwaraka Nagar, Khammam, State of Telangana under Drunken and Drive case under Sections 185(a), 130/177, 207 of M.V.Act without any jurisdiction. Hence, the present writ petition is filed seeking direction to respondents to release the subject vehicle. Learned counsel for the petitioner submits that in similar circumstances, this Court disposed of WP.No.2361 of 2019, dated 07-02-2019. The same is not disputed by learned Assistant Government Pleader for Home.

Though the petitioner filed writ petition, the subject vehicle is registered in the name of one P.Rajaya Lakshmi as stated supra. In view of the same, for the reasons alike in the said order, this writ petition is disposed of directing P.Rajya Lakshmi W/o.Anil Kumar R/o.7-3-301/A/502, Rishitha Towers, Dwaraka Nagar, Khammam, to appear before the 3rd respondent with RC book relating to subject vehicle and also producing proof of her identity and thereupon the 3rd respondent or other official who has the custody of the subject vehicle shall release the same to said Rajya Lakshmi forthwith.
