This petition is filed seeking for quash of the proceedings in Cr.No.18 of 2011 on the file of the Muthukuru Police Station, SPSR Nellore District.

Heard counsel for the petitioners, counsel for the second respondent and the learned Public Prosecutor, who takes notice for first respondent.

The complaint is filed by the complainant alleging that on a suspicion that she committed theft in the house of the petitioners, they beat her. The counsel for the petitioners now submits that the complainant has withdrawn the complaint by virtue of a letter dated 14.04.2011 given to the SDPO, Nellore. A copy of the said letter is also furnished, which is not disputed by the counsel for the second respondent.

Hence, in view of the above, continuation of further proceedings in the crime would only result in abuse of process of law and sheer waste of judicial time.

The criminal petition is allowed and all further proceedings in Cr.No.18 of 2011 on the file of the Muthukuru Police Station, SPSR Nellore District against the petitioners are hereby quashed.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
