THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.26353 of 2009 ORDER:

The petitioner challenges order dated 17.04.2009 in M.P.No.37 of 2005.

2. Through the award impugned in the writ petition, the Central Government Industrial Tribunal - cum - Labour Court directed the petitioner herein to pay a sum of Rs.51,570/- to the second respondent.

3. The writ petition is dismissed for default against the second respondent for non-compliance of conditional order dated 12.12.2012.

4. After lapse of three and half years, it appears that no steps are taken to rectify the defect. Since the writ petition is dismissed against the contesting respondent, the prayer cannot be considered. Accordingly, the writ petition is dismissed. It is open to the petitioner, if so advised, to file appropriate petitions for restoration as well as setting aside the default order against the second respondent. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
