THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CIVIL REVISION PETITION No.2795 of 2013 ORDER:

This Civil Revision Petition is filed against the order, dated 25.02.2013, in E.P.No.6/2012 in O.P.No.57/1990 on the file of the Court of the learned I Additional Senior Civil Judge, Rangareddy District, allowing the E.P. and making order of attachment absolute. Now, learned counsels for both sides submit that pursuant to deposit of amount by the beneficiary, the amount was deposited before the Executing Court. Learned counsel for the respondent also submits that the claimant was permitted to withdraw the amount, deposited by the petitioner before the Executing Court without furnishing any security.

In view of the above, the order, dated 25.02.2013, in E.P.No.6/2012 in O.P. No.57/1990 on the file of the Court of the learned I Additional Senior Civil Judge, Rangareddy District, is set aside, and this Civil Revision Petition is allowed. No order as to costs. However, it is open to the respondent to take necessary steps for withdrawal of the amount.

Miscellaneous Petitions, if any, pending in this Civil Revision Petition shall stand closed.
