HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.17276 OF 2018 O R D E R :

This petition is filed for a writ of Mandamus declaring the action of the respondent Nos.1 & 2 in summoning the petitioner to the police station under the guise of investigation even without following due process of law, as arbitrary and illegal. Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Home produced written instructions stating that petitioner is involved in almost 13 cases and rowdy sheet is being maintained in Nandigama Police Station vide Rowdy Sheet No.129, opened on 12.11.2010. It is also stated that the petitioner was arrested on 16/17.01.2018 in Crime No.29/2018 and was produced before concerned magistrate on 17.01.2018, and that the concerned Magistrate refused to remand the accused and directed to issue 41(A) Cr.P.C Notice, as such, he was brought back to the police station and Sec.41(A) Cr.P.C. Notice was issued to the petitioner. It is further stated that respondent Nos.1 and 2 have called the petitioner to police station as he was involved in Crime No.87/2018, Crime No.103/2018 and Crime No.104/2018 for investigating purpose and that they have never harassed the petitioner in any manner.

Recording the aforesaid submission of the learned Assistant Government Pleader for Home, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
