HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.30043 of 2013 ORDER:

By order dated 02.09.2005, petitioner was retired from service on the ground that he was unfit to work as Driver due to health condition. This writ petition is filed praying to issue direction to the respondents to arrange reinstatement of the petitioner into service.

This Court, by order dated 20.02.2014, directed the respondents to conduct medical examination afresh and consider the case for alternative employment. In pursuant to the interim order, petitioner was provided employment as Shramik and during the course of time, on account of attaining the age of superannuation, petitioner retired from service. Thus, cause in the writ petition does not survive on account of provision of alternative employment as Shramik after he was declared unfit to work as Driver and it is accordingly closed. If petitioner has any grievance on pay fixation and other benefits applicable to him in accordance with the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 or Act, 2016, he has to work out his grievance independently.
