N.Murali v. The State Of Andhra Pradesh,
HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.26763 of 2015 ORDER:
Heard Sri AVVSN Murthy, learned counsel appearing for the petitioner, the learned Government Pleader for Panchayat Raj and Rural Development and Sri M.S.R.Chandra Murthy, learned special counsel for the 4th respondent.
2 . The petitioner was appointed as Technical Assistant at Machavaram Mandal, Guntur District in the year 2007 under MGNREG Scheme. On certain allegations/charges against the petitioner, an enquiry was conducted by the 3rd respondent-Project Director and the petitioner was terminated by order dated 14.05.2013. Feeling aggrieved, the petitioner preferred an appeal to the 2nd respondentCommissioner, Rural Development. The 2nd respondent-Appellate Authority, by order dated 20.07.2013, remitted the matter back to the 3rd respondent to conduct a fresh enquiry after affording an opportunity of personal hearing to the petitioner and pass appropriate orders. Though the order was passed on 20.07.2013, so far the 3rd respondent did not fix up the date of enquiry. The 3rd respondent-Project Director ought to have conducted enquiry within a reasonable time after the order passed by the Appellate Authority. The inaction on the part of the 3rd respondent is impugned in the present writ petition.
3. Having regard to the facts and circumstances of the case, the 3rd respondent-Project Director is directed to fix the date of personal hearing and conduct enquiry into the allegations levelled against the petitioner and pass appropriate orders within a period of six (6) weeks from the date of receipt of a copy of this order.
4. The writ petition is accordingly disposed of. Pending
miscellaneous petitions, if any, in this writ petition, shall stand closed. No order as to costs.
