HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19780 OF 2016 ORDER:
The case of the petitioner is that the petitioner preferred an appeal before the Employees provident Fund Appellate Tribunal under 7-D read with 7-I of EPF & MP Act, 1952 at New Delhi against the impugned order dated 19.04.2016. Meanwhile, the Government of India issued a notification constituting a Bench for Southern Region at Banglore stating that all the appeals that are filed in New Delhi would be transferred to Banglore for adjudication, which also includes the petitioner's appeal. But the respondent authorities without waiting for the disposal of the appeal filed by the petitioner are taking steps for recovery of the demanded amount by issuing notice dated 19.04.2016.
Heard the learned counsel for the petitioner and Sri B.Narasimha Swamy, learned Standing counsel for respondents. In view of the same, it is for the petitioner to take steps in the appeal that is transferred from Delhi to Banglore. Meanwhile, there shall be stay of further proceedings in pursuance of the Form No.E.P.F. C.P.I, Notice of demand vide RC.No.GRGNT 669/0048568/15/04/2016/502/35/1099, dated 19.04.2016 issued by the 1st respondent, subject to payment of 50% of the demand amount within four
(4) weeks from the date of receipt of copy of this order. With the above direction, the writ petition is disposed of. There shall be no order as to costs.
