It is nothing shown of the earlier bail granted on 30.03.2015 in Crl.M.P.No.313 of 2015 at the crime stage of Crime No.695 of 2014 is cancelled under Section 439(2) Cr.P.C. Once the bail is not cancelled under Section 439(2) Cr.P.C. and the bail order is in force and there is no statutory provision either under Code of Criminal Procedure or under the N.D.P.S.Act of giving of N.B.W. or execution of N.B.W. tantamounts to cancellation of bail. Leave about giving of N.B.W. is no cancellation for provision is there under Section 70 Cr.P.C. for recall of warrant.

Having regard to the above, the criminal petition is dismissed. However, it is left open to work out the remedies if at all to pay the penalty by the accused on the earlier bonds and furnish fresh solvency.
