THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.5398 of 2019 ORDER :

The present Criminal Petition is filed seeking modification of the conditions imposed in the order dated 30.07.2019 passed in Crl.M.P.No.1706 of 2019 in Crl.Appeal No.665 of 2019 on the file of the II Additional Metropolitan Sessions Judge, Hyderabad.

By an order, dated 30.07.2019 passed in Crl.M.P.No.1706 of 2019 in Crl.A.No.665 of 2019, the learned II Additional Metropolitan Sessions Judge, Hyderabad, suspended the sentence imposed against the petitioners in C.C.No.576 of 2017, subject to the condition that the petitioners shall deposit 20% of the fine amount before the trial Court on or before 27.08.2019.

Learned counsel for the petitioners submits that the condition to pay 20% of the fine amount is excessive and the petitioners are not in a position to pay the same and the I.P. filed by them is pending adjudication. 4.

Having regard to the facts and circumstances of the case, instead of paying 20% of the fine amount, the petitioners are directed to pay 10% of the fine amount within a period of eight weeks from the date of receipt of a copy of this Court.
