HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 17444 of 2017 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus, declaring the action of respondent Nos.3 and 4 in interfering with the peaceful possession and enjoyment of the property admeasuring Ac.3.20 gts., in Sy.No.1, Hashamathpet Village, Balanagar Mandal, Ranga Reddy District as illegal, arbitrary and violation of the order dated 12.04.2017 passed in I.A.No.515 of 2017 in O.S.No.355 of 2017 on the file of the XV Additional District and Sessions Judge-cum-II Additional Family Judge, Kukatpally at Miyapur, Ranga Reddy District; and consequently restrain respondent Nos.3 and 4 from interfering with the peaceful possession and enjoyment of the petitioner over the said property.

2) By an order dated 02.06.2017, this Court while giving time to the Government Pleader for Home to get instructions, passed the following order:

" It is made clear that any action taken by the respondent-police shall only be in accordance with law."

3) Today, when the matter is taken up for hearing, the Government Pleader for Home (TG), on written instructions denied the allegations made in the affidavit with regard to involvement of respondent Nos.1 to 4 in the dispute between the petitioner and respondent No.5. However, states that two cases

came to be registered in Alwal Police Station 1)Crime No.270 of 2017 for the offences punishable under Sections 447, 427 and 506 read with 34 IPC and (2) Crime No.283 of 2017 for the offences punishable under Sections 447 and 427 IPC and investigation in both the cases is going on.

4) Having regard to the statement made, the present writ petition is disposed of directing respondent Nos.1 to 4 not to interfere with the civil disputes, but however, if any action is to be taken against any of the parties, the same shall be in accordance with law.

5) There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
