HON'BLE SRI JUSTICE SURESH KUMAR KAIT Crl.P. No. 16393 of 2016 O R D E R :- This Criminal Petition is filed under Section 438 Cr.P.C. seeking to grant anticipatory bail to the petitioners - A2 and A3 in the event of their arrest in connection with Cr.No.203 of 2016 of Proddatur Rural Police Station, YSR Kadapa District, registered for the offences punishable under Sections 147, 148, 324 and 307 read with 149 IPC.

The learned Additional Public Prosecutor appearing on behalf of the respondent - State has submitted that previously the petitioners filed W.P.No. 39371 of 2016 before this Court seeking to quash the present F.I.R. and stay all further proceedings including their arrest. Since the petitioners have not obtained any orders in their favour so far, they have resorted to file the present petition seeking to grant anticipatory bail.

It is not in dispute that in the aforesaid writ petition, the petitioners sought not only to quash FIR but also to stay their arrest.

In the present petition, the petitioners seek anticipatory bail in the event of their arrest. The fact of filing writ petition earlier has not been disclosed by the petitioners. Hence, the present petition is liable to be dismissed on the

SKK,J Crl.P_16393_2016 ground of concealment of facts. However, inasmuch as no relief has been granted in the writ petition and in view of the facts and circumstances of the case, I am also not inclined to grant anticipatory bail to the petitioners.

Accordingly, this Criminal Petition is dismissed. As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
