THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.20192 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ or order or direction, more particularly one in the nature of writ of mandamus declaring the inaction of the respondents 1 to 4 in not taking any action against the illegal construction, which is being made by the 5th respondent in Door No.23/41, Mulapet, Nellore, contrary to the sanctioned plan proceedings B.A.No.90/2014, G.S. dated 11.04.2016, without leaving road affecting area and set backs on 4 sides and constructing G+3 is arbitrary, illegal and contrary to the provisions of the Hyderabad Municipal Corporation Act and consequently direct the respondents 1 to 4 to cause demolition of the illegal construction being made by the 5th respondent in violation of the sanctioned plan as enunciated in inspection report dated 21.03.2017, in the interest of justice. "

After arguing for sometime, learned counsel for the petitioner requested the Court to direct respondent No.2 herein to consider the representation, dated 27.04.2017, of the petitioner and take appropriate action in accordance with law.

Considering the facts and circumstances of the case and the grievance of the petitioner, without going into the merits of the case, respondent No.2 is hereby directed to consider the representation, dated 27.04.2017, of the petitioner and take appropriate action in accordance with law regarding the illegal

construction alleged to have been made by respondent No.5 as expeditiously as possible.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
