Duggirala Satyadev S/o.late D.Parthasaradhi, Aged about 63 yrs, Occu : Business, Presently R/o.Plot No.39, Flat No.B-1, Rajasri Apartments, Srinagar Colony, Punjagutta, Hyderabad ..
Petitioner And The State of Telangana, Rep., by its Principal Secretary, Revenue Department, Secretariat, Hyderabad & others .. Respondents This court made the following :
- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.16504 of 2018 ORDER :
Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents. 2.
According to petitioner his father was owner of land to an extent of Ac.30.00 in Sy.Nos.340, 341, 375 and 376 of Bommaraspet Village, Shamirpet Mandal, Medchal District and petitioner succeeded to the said property after the death of his father. Petitioner contends that some third party names are reflected in the revenue records in the place of his father. Aggrieved thereby petitioner filed Revision No.D5/527/14 before the Joint Collector, Ranga Reddy District. Alleging inaction on the said revision, this writ petition is filed.
3.
A bare perusal of the averments of the affidavit filed in support of the writ petition and the grounds urged in the revision petition, would show that third party names are reflected in the revenue records. That being so, petitioner cannot seek adjudication by the Joint Collector in the revision pending before him in the absence of persons who will be affected in the event of allowing the revision. On noting these infirmities, learned counsel for the petitioner fairly submits that petitioner would be advised to take steps to implead persons whose names are reflected in the revenue records against the above mentioned survey numbers.
- 3 - 4.
Having regard to this submission, the Writ Petition is disposed of granting liberty to the petitioner to file an application in the pending revision before the Joint Collector, to implead the persons whose names are reflected in the revenue records. On filing such application, after causing notice on the said persons and on hearing respective parties, the Joint Collector shall finalise the pending revision. There shall be no order as to costs. Miscellaneous petitions, pending if any, in this writ petition shall stand closed.
