Heard the counsel for petitioners, the learned Government Pleader for Revenue, and the learned Government Pleader for Home, for respondents.

The petitioners herein have presented documents for registration before the 2nd respondent and contend that the 2nd respondent has refused to register the same on the basis of a letter dt.17.02.2016 addressed to 2nd respondent by 4th respondent directing the 2nd respondent not to register any transactions in respect of land of the petitioners on the ground that there is a criminal case under investigation with the 4th respondent.

The learned Government Pleader for Revenue and the learned Government Pleader for Home are unable to point out any provision in any statute empowering the 4th respondent to address such letters to 2nd respondent prohibiting him from registering any documents. 4.

Therefore, the Writ Petitions are allowed. The petitioners are directed to present the documents for registration before the 2nd respondent, and on such presentation of the said document / documents by petitioners, the 2nd respondent, without reference to the letter dt.17.02.2016 of the 4th respondent, shall consider the same for registration in accordance with the provisions of the Registration Act,

1908 and Stamp Act, 1899, and take further action in the matter within a period of 2 months from the date of presentation of such document by petitioners, and communicate the same to petitioners. 5.

As a sequel, miscellaneous petitions pending if any in these Writ Petitions, shall stand closed.
