ORDER

The petitioner is running fair price shop No.3 at Anumasamudram Village, A.S.Pet Mandal, SPSR Nellore District. The authorization of the petitioner granted on 17.6.2016 has been renewed from time to time. While so, the 3rd respondent passed an order of suspension on 19.12.2016 and issued a show cause notice on the same day, calling for explanation with regard to the charges framed against the petitioner on the allegation that when the Inspector, Anumasamundram visited the fair price shop, variations in the stocks was found, for which, the petitioner submitted his explanation. When no orders were passed subsequent thereto, the present writ petition is filed challenging the order of suspension.

A perusal of the order of suspension shows that there were variations in the stocks of the petitioner's fair price shop and the matter has been enquired by the 3rd respondent. No counter is filed in spite of giving an opportunity on 6.3.2017.

In the circumstances, if no orders are passed pursuant to the show cause notice dated 19.12.2016, the 3rd respondent shall conduct enquiry following due process of law and pass appropriate orders as expeditiously as possible, but not later than six months from the date of receipt of a copy of this order.
