THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9876 OF 2016 ORDER:

This Criminal Petition is filed by the petitioners/A-1, A-2 and A-4 under Section 438 Cr.P.C. seeking anticipatory bail in Crime No.32 of 2015 of Patnam Police Station, Ananthapur District, registered for the offences punishable under Section 420 read with 34 I.P.C.

2. Heard and perused the material available on record.

3. The allegation against the petitioners is that on 10.4.2015, at about 3:30 P.M., near Malakavemula Cross, Mudigubba Mandal, Ananthapur District, they along with A-3 cheated the de facto complainant by collecting an amount of Rs.2 crores.

4. Learned counsel for the petitioners submitted that the petitioners are innocent of the offences alleged against them and they have been falsely implicated in the present case; that the petitioners will cooperate with the investigation and will not flee from the hands of police.

5. Learned Additional Public Prosecutor opposed to grant bail to the petitioners.

6. Previous cases are also pending against the petitioners. The amount involved in this crime is Rs.2 crores. Hence, this Court is not inclined to grant anticipatory bail to the petitioners.
