HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.18874 of 2019 ORDER:

This writ petition is filed by the petitioners declaring the action of respondent No.3 - Tahsildar, Charla Mandal, Bhadradri Kothagudem District, in interfering with their possession and enjoyment over the subject land in Sy.No.41/2 to an extent of Acs.8.25 cents and also Sy.No.42/16 to an extent of Ac.1.08 cents, situated at Kesavpuram (G) Village, Charla Mandal, Bhadradri District, as arbitrary and illegal.

Learned counsel for the petitioners contends that the 3rd respondent is interfering with the peaceful possession and enjoyment over the subject land of the petitioners at the instance of unofficial respondent Nos.4 to 21. It is also contended that insofar as respondent Nos.4 to 21 are concerned, the petitioners are not seeking any relief in the present writ petition.

On the other hand, the learned Assistant Government Pleader for Revenue appearing for respondent Nos.1 to 3, on instructions, submits that a bald allegation is made by the petitioners that respondent No.3 - Tahsildar is interfering with their possession and enjoyment over the subject land and, in fact, there is no such interference either by the Tahsildar or any other person from his office.

CKR, J W.P.No.18874 of 2019 In view of the same, placing the above submission made by the learned Assistant Government Pleader for Revenue on record, this writ petition is closed, making it clear that respondent No.3 - Tahsildar or anybody claiming through him shall not interfere with the possession and enjoyment over the subject land by the petitioners. As the petitioners have not sought any relief against respondent Nos.4 to 21, it is made clear that no injunction orders are granted by this Court against respondent Nos.4 to 21 in this writ petition. No order as to costs.

Miscellaneous petitions pending, if any, in this writ petition shall stand closed.
