THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.1970 of 2008 ORDER:

The petitioner was initially selected as Conductor by proceedings of the Selection Committee, dated 30.10.1998, and she was appointed as Conductor by office order, dated 02.05.2000. Thereafter, she was disengaged and as re-engaged by another order, dated 14.10.2001. She was removed from service by proceedings, dated 29.01.2002 on the allegation of some cash and ticket irregularities. However, on her appeal, she was appointed as fresh casual Conductor by office order, dated 16.05.2002. But, her services were disengaged and were re-engaged as casual Conductor by office order, dated 02.06.2003. Thereafter, she had been working regularly and in spite of the same, her services were not regularized. In those circumstances, she filed the present Writ Petition.

Now, a counter-affidavit is filed stating that she is not eligible for regularization on par with other casual Conductors, who were appointed with effect from 05.05.2000. It is also stated that the casual Conductors were regularized as per the vacancies and seniority and the details of the petitioner are furnished as follows:

1. Date of initial appointment as casual conductor 04.05.2000

2. Dis-engagement due to slack season curtailment 01.07.2000

3. Re-engagement as casual conductor at Nandyal depot 16.11.2001

4. Dis-engagement (Termination) for C&T irregularities committed on 01.11.2001 on route Nandyal-Palukur while performing the service during the strike period from 14.10.2001 to 07.11.2001.

5. Appointed as a fresh casual conductor by DVM/NDL 17.05.2002

6. Dis-engagement due to slack season curtailment 01.07.2002

7. Re-engagement as casual conductor at Devarakonda depot of Nalgonda Region 03.06.2004

8. Dis-engagement due to slack season curtailment 01.07.2003

9. Re-engagement as casual conductor at Srikahalastri depot of Chittoor region 09.03.2004

10. Dis-engagement at Srikalahasti Depot 31.05.2007

11. Re-engagement at Nandyal Depot 04.06.2007 It is also stated that the petitioner was censured on 17 times; imposed fine in cash and ticket irregularities four times; and once her services were terminated on 29.01.2002 on the allegation of cash and ticket irregularities. However, her case was considered in appeal and appointed as fresh casual Conductor with effect from 17.05.2002.

The above facts make it clear that though the petitioner was appointed on various occasions, ultimately, she was appointed as casual Conductor with effect from 17.05.2002. Thereafter, also there were several disengagements and re-engagements. 4.

Now, learned Standing Counsel for the respondentCorporation submits that the services of the petitioner were regularized with effect from 01.07.2009.

In view of the same, since the relief of the petitioner was already granted by the respondent-Corporation, no further orders are necessary in the writ petition and accordingly, the Writ Petition is closed.
