HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.29513 of 2017 ORDER:

Heard the learned counsel for the petitioner and learned Government Pleader for Home (TG) and, with their consent, the writ petition is disposed of at the stage of admission. Petitioner is aggrieved with continuation of rowdy sheet opened on 16.06.2014.

Petitioner states that while he was shown as accused in three criminal cases, which ended in acquittal and, in spite of the same, respondents are continuing rowdy sheet which is harming his reputation in Society apart from creating various hurdles and, he essentially being an agriculturist, is unable to live with honour and respect in the Society. Petitioner, therefore, seeks a writ of mandamus to respondents to delete his name from the list of rowdy sheet.

Learned Government Pleader for Home (TS) submits that the petitioner neither had made any representation nor approached the authorities concerned for deletion of his name from the list of rowdy sheet and, in the event of approaching the authorities, the same would be considered. In K.Suresh Babu v. Superintendent of Police, Ananthapur District1 and M.Malla Reddy v. State of Telangana2, this Court had categorically held that either opening and continuation of rowdy sheet cannot be done in a 1 2016(1) ALD (Crl.) 210 2 2016(1) ald (Crl.) 591

routine manner merely on account of individual being involved occasionally in certain crimes.

In the circumstances, the Writ Petition is disposed of with a direction to respondent No.3 - Assistant Commissioner of Police, Rachakonda Commissionerate to take appropriate decision, whether rowdy sheet opened against the petitioner in the year 2016 is still required to be continued or not, and communicate the same to the petitioner within a period of eight weeks from the date of receipt of a copy of the order. Miscellaneous Petition pending, if any, shall also stand dismissed. However, in the circumstances, without costs. ____________________________ CHALLA KODANDA RAM,J Date: 05.09.2017 usd
