THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9125 of 2016 ORDER:

This Criminal Petition is filed by the petitioner-accused No.1 under Section 439 (1) (b) Cr.P.C. seeking to relax the conditions imposed by the Court below, while granting bail to him vide order, dated 13.04.2016, in Crl.M.P. No.157 of 2016 in Crime No.14 of 2016 by the Principal District and Sessions Judge, Srikakulam. Heard and perused the material available on record. The case in brief is that the petitioner is accused in Crime No.14 of 2016 on the file of the Kotabommali Police Station, Srikakulam District, for the offence punishable under Section 304(B) IPC, and he filed Crl.MP No.157 of 2016 before the Court below for grant of bail. While granting bail to the petitioner vide order impugned, the learned Sessions Judge directed him not to leave Srikakulam District without prior permission of the Court until further orders and also attend him before the Station House Officer, Kotabommali Police Station on every Saturday between 9.00 a.m., to 1.30 p.m., till filing of charge sheet, apart from other conditions.

Learned counsel for the petitioner submitted that the petitioner is working as Constable (GD) in the Ministry of Home Affairs in SSB DCopy, 10th BN, SSB Bat Mall District, Srinagar and since he has to join his duties in Srinagar, the above conditions may be relaxed. Considering the facts and circumstances of the case and also considering the submissions of the learned counsel for the petitioner, this Court is inclined to pass the following order: "The conditions imposed against the petitioner, i.e. (i) not to leave Srikakulam District without prior permission of the Court until further orders; and (ii) to attend before the Station House Officer, Kotabommali Police Station on every Saturday between 9.00 a.m., to

1.30 p.m., till filing of charge sheet, by the Principal District & Sessions Judge, Srikakulam are hereby relaxed.

The other conditions in the above said order shall stand unaltered."
