O R D E R
The case of the petitioners is that the private respondent No.7 is making illegal construction in the subject land, and though they made representation dated 16.05.2019 to the official respondents, no action has been taken till date. Heard the learned counsel for the petitioner, Government Pleader for Municipal Administration for respondent No.1, and Sri N.Praveen Kumar for respondents 4 to 6.
Sri Y.Rama Rao, learned Standing Counsel for Hyderabad Metropolitan Development Authority (HMDA), for respondents 2 and 3, on instructions, submits that private respondent No.7 was sanctioned building permission in file No.016804/SKP/R1/U6/HMDA dated 22.12.2018, and based on the complaint of the 5th petitioner seeking to cancel the said building permission, Secretary, HMDA, initiated proceedings No.016804/ SKP/ R1/ U6/ HMDA dated 26.06.2019, and the enquiry in this regard will be concluded within a period of eight weeks.
In view of the above submission of the learned Standing Counsel for HMDA, without expressing any opinion on merits, writ petition is disposed of directing the Secretary, HMDA, who is stated to be conducting the enquiry vide proceedings dated 26.06.2019, to conclude the same in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order, after giving notice and opportunity of hearing to all the affected parties. Interlocutory applications pending, if any, shall stand closed. No order as to costs.
