THE HONOURABLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION NO.18932 OF 2019 ORDER:

Questioning the inaction of the respondents 1 to 3 in taking any action basing on the FIR No.77 of 2013 of Langer House Police station dated 02.03.2013, even though the same is registered for offences cognizable and non-bailable, is nothing but arbitrary, illegal, null and void and violative of principles of natural justice and also violative of Articles 14, 19 and 21 of the Constitution of India.

Heard Sri K. Venumadhav, learned Counsel for the petitioner and the learned Assistant Government Pleader for Home.

The learned Assistant Government Pleader for Home, on written instructions dated 27.09.2019 which is placed on record of this Court, submits that the allegation in the Writ Petition that the official respondents are not investigating into the crime basing on FIR No.77 of 2013 is incorrect and inasmuch as the authorities have been diligently investigated the case by interrogating the suspects which did not yield any clues. It is further submitted by the Assistant Government Pleader that the Investigating Officer made a

representation to the Inspector of Police, Finger Prints Bureau, CCS, Hyderabad with a request to compare the finger prints slips of the inmates/complainant and other suspect persons for taking further action. Based on such representation made by the 3rd respondent, the Inspector of Police, Finger Prints Bureau, submitted report dated 04.03.2013 that "No. of chance finger prints under comparison - Nil". It is also stated that the Investigating Officer verified the previous records of the police station and bordering police station and listed out the criminals who have committed such types of offences previously and also checked their complicity, but no clues came up.

Learned Assistant Government Pleader for Home submits that the Investigating Officer having failed to secure any leads for further investigation, after obtaining permission from the Deputy Commissioner of Police, West Zone, vide No.HW5/Cr/5252/2013 dated 28.12.2013, and after serving notice to the complainant on 25.09.2019 which is duly acknowledged by the complainant by affixing signature thereon, filed a final report before the VI Additional Chief Metropolitan Magistrate, Hyderabad vide SR. No.5500 of 2019 dated 26.09.

undetected for the time being. If any clues come forth in future, the case will be reopened for further investigation. Recording the said statement on behalf of the 3rd respondent, no orders need be passed in this matter. Accordingly, the Writ Petition is closed.

The miscellaneous petitions pending, if any, shall stand closed.
